BAAQMD has adopted zero-NOx standards for certain new water heaters, and additional amendments are currently under consideration. Requirements and effective dates vary by equipment type and may change. Per BAAQMD, a working water heater can stay in service until it burns out or needs replacement. The rule applies when new equipment is sold or installed.
Requirements are based on the water heater's BTU rating and date of manufacture — not on your home's age or a property sale.
The BAAQMD Board is scheduled to consider Rule 9-6 amendments on November 4, 2026. If approved, they would add some exemptions and extend the compliance date.
